Dopo che per mesi abbiamo aspramente criticato l\u2019uso del Dpcm, non riesco a capire perch\u00e9 il Governo, che pure lodevolmente il 22 febbraio ha fatto ricorso allo strumento costituzionale del decreto-legge, sia ritornato ad usarlo. Il decreto-legge non \u00e8 di un minuto pi\u00f9 lento nell\u2019entrata in vigore, ed \u00e8 al riparo da ogni contestazione di carattere costituzionale. Ci\u00f2 che dovrebbe far pensare non \u00e8 l\u2019attuale situazione, che tutti riconoscono, sia pure con sfumature diverse, essere di emergenza. Ma il rischio \u00e8 che un futuro Governo usi questo precedente per altre situazioni, limitando le libert\u00e0 costituzionali con uno strumento che non ha il vaglio preventivo del Presidente della Repubblica e non pu\u00f2 essere annullato in pochi giorni dal Parlamento, come invece i Costituenti hanno previsto per i decreti-legge. In quel caso, chi potrebbe impedirlo? Thomas Jefferson, da governatore della Virginia si rifiut\u00f2 di usare strumenti fuori dalla Costituzione dello Stato neppure sotto l\u2019occupazione inglese durante la guerra di indipendenza per non creare pericolosi precedenti.
